The Differences Between Juvenile & Criminal Law
The biggest difference between the criminal justice system for juvenile and adult offenders is the type of facilities in which they are housed before, during, and after their trials. For example, most juvenile defendants are released to their parents’ custody following an arrest until their trial. If the child is convicted of the crime, they will be sent to a juvenile detention center, not to a jail with adults.
Most often, however, juvenile offenders are given opportunities for alternative punishments. These include probation, deferral, rehabilitation programs, community service, and more. Conversely, exceedingly violent crimes usually result in time served and can potentially influence a judge to order the child be tried as an adult.
